Program Focus
Giving good direct testimony as an expert is worthless if you cannot hold up under strong cross examination, where your credibility is put to the test in front of jurors. Your ability to respond well under cross depends not primarily on your expert knowledge, but on your understanding of how to play the “game” of cross so that you can defend your credibility, maintain some control over the exchange and maintain your emotional composure. Mike Tiktinsky and Sarah Murray will teach you the fundamentals of playing the “game” of cross and give you helpful tips and tricks for keeping your cool when the trial heat is on.

What You Will Learn
Participants will learn what to expect in cross and how to prepare effectively to defend one’s expertise and credibility, regardless of your level of experience as an expert. We will discuss the most common cross question types and teach you how to use the structure of these questions against opposing counsel so that you can maintain your demeanor and strength of presentation on cross.

Anyone who wants to learn the theory and basic tactics of cross, including attorneys, CPAs, Engineers, Real Estate Brokers, Medical Practitioners, Insurance Brokers, Consultants and others who serve as experts in litigation matters and as expert witnesses.

Presenters

Sarah Murray, M.A.

Sarah Murray is a social/cultural anthropologist who has been a Senior Consultant in Trial Behavior Consulting’s San Francisco office for 11 years. She received her B.A. from Bryn Mawr College and did graduate work at UC-Berkeley, where she was a Fulbright Scholar. Sarah has spent many hours helping to prepare professionals, including stock brokers, commodities traders, industrial hygienists, physicians, nurses, world class engineers, and CEOs, for both expert and fact testimony in state and federal courts and in administrative hearings. She has served as a trainer in NACVA’s litigation boot camp program for six years, teaching the fundamentals of effective trial communication. She takes special joy in translating the insights of social science into practical tips for testifying persuasively at trial.

Mike Tiktinsky, Ph.D., MPH

Mike Tiktinsky is a licensed psychologist with additional degrees in statistics and public health who has worked as a Senior Consultant in Trial Behavior Consulting’s San Francisco office for over 15 years. Mike was educated at UC-Berkeley. He translates his skills in personality assessment and coaching into his witness prep work, where he excels at teaching witnesses the rules of cross and helping them to improve testimonial demeanor. Mike specializes in complex commercial disputes and patent cases and has worked on over 65 patent cases around the country. Mike understands being an expert from the inside out, having served as a statistics and data expert in numerous employment discrimination cases. He also honed his skills through years of coaching the Napa High School mock trial team to numerous state championships.
